1. Acceptance of Terms

Welcome to Gainlog. These Terms of Service (“Terms”) govern your use of the Gainlog mobile application (“Gainlog”, the “app”, “we”, “us”, or “our”), operated by Diego Soro, an individual developer based in Spain.

By creating an account or using the app, you agree to be bound by these Terms. If you do not agree, do not use the app.

2. Eligibility

You must be at least 13 years old to use Gainlog. By using the app, you confirm that you meet this minimum age requirement.

If you are under the age of majority in your jurisdiction, you confirm that you have the consent of a parent or legal guardian to use the app.

3. Your Account

• You are responsible for keeping your account credentials secure.
• You are responsible for all activity that happens under your account.
• You agree to provide accurate information when signing up.
• You may delete your account at any time via Settings › Profile › Delete Account.

4. User-Generated Content

You retain ownership of the content you post in Gainlog (workouts, comments, photos, etc.). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to host, display and distribute that content within the app.

You agree NOT to post content that:

• Is illegal, harmful, threatening, harassing or defamatory
• Contains hate speech, violence, sexual content, or promotes self-harm
• Infringes the intellectual property rights of others
• Impersonates another person or misrepresents your identity
• Contains spam, scams or unsolicited commercial messages
• Violates any applicable law or regulation

5. Moderation and Enforcement

We do not pre-screen content but reserve the right to:

• Review content reported by users
• Remove content that violates these Terms
• Suspend or terminate accounts that engage in abusive behavior

Gainlog includes tools to report content and block users. We aim to respond to reports of abusive content within 24 hours.

6. AI-Generated Content

Gainlog uses third-party AI services (currently Anthropic Claude) to generate workout plans. AI-generated content is provided as a suggestion only and is not medical, fitness or professional advice.

Always consult a qualified professional before starting a new fitness program. Use AI-generated plans at your own risk.

7. Health Disclaimer

Gainlog is a fitness tracking and planning app. It is not a medical device and does not provide medical advice. Information in the app is for general informational purposes only.

Consult a qualified healthcare professional before starting any exercise program, especially if you have a pre-existing medical condition or any physical limitation. You assume all risk and responsibility for your use of the app.

8. Intellectual Property

The Gainlog name, logo, design, and code are owned by Diego Soro. You may not copy, modify, distribute, sell or lease any part of the app without our written permission.

9. Third-Party Services

Gainlog integrates with third-party services (Clerk, Cloudflare, Anthropic, RapidAPI, Apple, Google). Your use of those services is also subject to their own terms and privacy policies.

10. Termination

We may suspend or terminate your access to the app, with or without notice, if we believe you have violated these Terms or applicable law.

You may stop using the app and delete your account at any time.

11. Disclaimer of Warranties

The app is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not guarantee that the app will be uninterrupted, error-free or secure.

12. Limitation of Liability

To the maximum extent permitted by law, Diego Soro shall not be liable for any indirect, incidental, consequential, special or punitive damages arising out of or related to your use of the app, including but not limited to personal injury, loss of data, or loss of profits.

13. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page will reflect any changes. Continued use of the app after a change constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Spain. Any dispute arising out of or relating to these Terms shall be resolved in the competent courts of Spain.
